Terms of Service.

Please read carefully before subscribing to a Music Bingo hosting pack.

These terms govern your purchase and use of Music Bingo Australia hosting packs, whether as a recurring subscription or a one-off order, and set out the rights and obligations of both parties. By placing an order or subscribing, you acknowledge that you have read, understood, and agreed to these Terms of Service.

Subscription service

By subscribing to our Music Bingo hosting packs, you agree to receive recurring deliveries of hosting packs for use in hosting Music Bingo events at your venue. Subscriptions require a minimum lead time of 14 days from the date of order before your first show date. Invoicing is structured to build in a buffer against payment processing delays and postage times, so your packs always arrive with time to spare. Invoices are issued according to the following schedule:

  • Weekly service: Your first invoice covers 8 shows (8 consecutive weekly packs). Each following invoice covers 5 shows and is issued at your 5th show of the current batch, so payment always stays ahead of delivery.
  • Fortnightly service: Your first invoice covers 8 shows (8 fortnightly packs). Each following invoice covers 5 shows and is issued at your 5th show of the current batch.
  • Monthly service: Your first invoice covers 3 shows (3 consecutive monthly packs). Each following invoice covers 3 shows and is issued at your 2nd show of the current batch.

Payments are processed automatically by Stripe, our payment processor. You are responsible for maintaining accurate and up-to-date payment information in your account.

One-off orders

We also offer single-event hosting pack orders (available in L Pack and XL Pack sizes) for customers who want to run a Music Bingo night without committing to a subscription. One-off orders require a minimum lead time of 7 days from the date of order before your event date. Payment is taken in full at the time of order. After payment, you will be directed to select your rounds and provide your delivery details. Your packs are dispatched once your round selections and delivery address are confirmed. One-off orders are not refundable once packs have been dispatched.

Pricing and GST

All prices displayed on our website are exclusive of GST. GST (10%) is calculated and added automatically at checkout. Your invoice and payment receipt will show both the ex-GST amount and the GST component. By completing a purchase, you acknowledge and accept the final GST-inclusive amount charged.

Delivery and shipping

Delivery process

Hosting packs are shipped to the address provided during checkout. Subscription packs are dispatched ahead of your next billing cycle so your packs arrive before you need them. One-off packs are dispatched after your round selections are confirmed.

Shipping fees

Shipping is included in the pack price. There are no additional shipping fees at checkout.

Lost or damaged packages

While we take care in packaging and shipping, Music Bingo Australia is not responsible for packages lost, stolen, or damaged in transit. Please contact the shipping carrier directly to file a claim. If we can assist with a reprint or replacement, contact us and we will do our best to help.

Returned packages

If a package is returned to us because the delivery address provided was incorrect or incomplete, a re-shipping fee may be added to your next invoice. It is the customer's responsibility to ensure the address on file is accurate.

Find a Show listing

Active subscribers are listed on our Find a Show page, which helps players in your area discover your Music Bingo night. Your listing is activated when your subscription is confirmed and removed if your subscription is cancelled or if an invoice payment fails and is not recovered. Music Bingo Australia does not guarantee any minimum number of player enquiries or attendees via the finder.

Cancellation

You may cancel your subscription at any time through the billing portal accessible from your account. Cancellation takes effect at the end of your current paid billing period. You will not be charged again after cancelling, and your hosting packs and Find a Show listing remain active until the period ends. No refunds are provided for the current billing period on cancellation. Packs that have already been shipped or delivered cannot be refunded.

Pausing your subscription

You can pause your subscription for one billing cycle through the account portal. Pausing takes effect immediately and lasts for one full billing cycle (5 weeks for weekly service, 10 weeks for fortnightly service, or 3 months for monthly service). During a pause, no charges are made and your Find a Show listing is temporarily hidden. Your subscription resumes automatically at the end of the pause period. You can also resume early at any time via the portal. Only one pause period may be active at a time.

Payment failure

If a subscription payment fails, Stripe will attempt to collect payment automatically over the following days. During this time your Find a Show listing will be temporarily hidden. If payment is recovered, your listing is reinstated. If payment cannot be collected after retry attempts, your subscription will be cancelled and your listing removed. Any outstanding amounts for packs already shipped remain payable.

Refund policy

We do not offer refunds for hosting packs that have been shipped or delivered, or for the current billing period of an active subscription. If you believe a charge was made in error, please contact us within 14 days and we will investigate.

Outstanding payments

Any amounts owing for packs already delivered must be settled in full, even if a subscription is subsequently cancelled. Failure to settle outstanding amounts may result in suspension of future services or referral to a collections process.

Ownership and use

The Music Bingo hosting packs provided remain the property of Music Bingo Australia. You are granted a non-exclusive, non-transferable licence to use the hosting packs solely for the purpose of hosting Music Bingo events at your venue during your active subscription or for your confirmed one-off event.

Customer responsibilities

Proper use: You agree to use the hosting packs in accordance with the provided instructions and solely for hosting lawful Music Bingo events.

Non-distribution: You are strictly prohibited from sharing, distributing, or reselling the hosting packs without explicit written authorisation from Music Bingo Australia.

Music licensing

You are solely responsible for obtaining and maintaining the correct public performance music licensing for your venue, including any required licence from OneMusic Australia (covering APRA AMCOS and PPCA rights). Music Bingo Australia's hosting packs and Spotify-based playlists do not include or substitute for venue music licensing. By placing an order, you acknowledge it is your responsibility to ensure your venue complies with all applicable Australian laws regarding the public performance of music. Music Bingo Australia holds no liability for a venue's failure to secure or maintain the necessary licensing.

Prizes and entry fees

Music Bingo hosting packs are designed for free-to-play events. If you choose to charge an entry fee, require payment to participate, or offer prizes that require payment, you are solely responsible for ensuring your event complies with all applicable gambling, gaming, and licensing laws in your state or territory. Music Bingo Australia is not responsible for any legal or regulatory consequences arising from changes you make to the free-to-play format.

Third-party platforms

Our hosting packs are designed for use with Spotify. Music Bingo Australia is not responsible for any disruption, unavailability, or change to the functionality, pricing, or terms of Spotify or any other third-party platform. You are responsible for maintaining your own valid Spotify Premium account.

Fee changes

Music Bingo Australia may change subscription fees from time to time. Any fee change will take effect at your next invoice following reasonable prior notice. Continuing your subscription after a fee change takes effect constitutes your acceptance of the new fee.

Intellectual property

All intellectual property rights associated with the Music Bingo hosting packs, including trademarks, logos, and copyrighted materials, belong to Music Bingo Australia. You agree not to reproduce, modify, distribute, or create derivative works from the hosting packs without our prior written consent.

Limitation of liability

To the extent permitted by law, Music Bingo Australia's liability for any claim arising out of or relating to these terms or your use of our services is limited to the amount paid for the affected hosting packs. We are not liable for indirect, incidental, consequential, or exemplary damages, including loss of profits, data, or business opportunities.

Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited. If the Australian Consumer Law applies to a supply of goods or services by Music Bingo Australia, our liability is limited, to the extent permitted, to resupply of the goods or services or payment of the cost of resupply.

Privacy and data protection

We handle your personal information in accordance with our Privacy Policy. By placing an order or subscribing, you consent to the collection, use, and disclosure of your personal information as outlined in that policy.

Modifications

We reserve the right to modify or update these Terms of Service at any time. Changes take effect upon posting the revised terms on our website. Continued use of our services after changes are posted constitutes acceptance of the updated terms.

Termination rights

Music Bingo Australia reserves the right to terminate or suspend a subscription without refund in the following circumstances: non-payment of subscription fees, a material breach of these Terms of Service, or engagement in fraudulent activities.

Force majeure

Neither party is liable for delay or failure to perform their obligations if caused by events beyond their reasonable control, including natural disasters, acts of government, pandemics, or other force majeure events.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect.

Governing law

These Terms of Service are governed by the laws of Australia. Any disputes arising from or in connection with these terms are subject to the exclusive jurisdiction of the courts of Australia.
